Private Swimming Pools

Private swimming pools may be constructed, installed or located only in the rear yard of a single-family dwelling and within 10 feet of any side lot line, residence or other permanent structure. A pool must be equipped with a gated, lockable cover that will prevent unauthorized access and is capable of keeping the pool covered when not in use. In addition, the pool must be fully fenced and protected with an effective and durable fence at least 6 feet high and with an automatic self-closing gate.

The installation of a private swimming pool in any residential area requires a permit from the Department of Environment, Energy and Water Services (DEES). If you wish to build or install a pool, you must submit an application to DEES, along with a fee and site plan. The permit application must be approved before construction begins.
